​This document sets forth the terms and conditions for the use of the website and delineates the rights of the website user.

In the event of an order placement by the user, the aforementioned document serves as a contract between the user and "Sabcentral Studio" LLC.

Definition of Basic Terms

• Product - the products offered through the web page.

• User - any person who uses this web page, including visitors/browsers of the web page, individuals who place orders on the web page for the purpose of purchasing products, and service recipients, which includes visiting and browsing other paid pages available on the web page, referred to as "visitors/browsers for adults."

• Sabcentral Studio - the owner and legal administrator of the web page.

Introduction

 

1  SabCentral Studio and David Matchavariani provide users with the opportunity to view David Machavariani's works through the website and, if desired, to purchase the original works and prints, merchandise, and other products offered through the website, which represent Davit Machavariani's intellectual property;

2  The SabCentral studio is responsible for the delivery of products, including damage caused during transportation when delivered by a courier (loss or damage of goods), as well as damage caused by the malfunctioning of the web service, or any other violation that leads to the infringement of the rights of the user/service recipient as provided by the laws of Georgia on "Protection of Consumer Rights" and "Electronic Commerce."

3 User/Viewer Account. 

 

To fully use the web page services, it is necessary to create an account (profile). To open an account, the user/viewer must follow the instructions provided on the web page: specify the requested information and, if necessary, undergo verification.

 

Before creating an account, the user/viewer must ensure that this does not violate the legislation of Georgia and the rights of third parties.

 

The user/viewer bears full responsibility for the accuracy of the data provided during the account creation;

Purchasing products on the website and browsing / subscribing to club or exclusive pages is only permitted for adults.

 

The Sabcentral Studio reserves the right to additionally request the user/viewer to confirm the accuracy of the data provided on the platform. The user's/viewer's data will be processed in accordance with our privacy policy and legislation.

 

The user/viewer has the option to register and create an account using Google or Facebook. In this case, the user/viewer must also agree to the terms and conditions specified by Google and Facebook, for which the user is responsible.

 

The user/viewer is responsible for the secure storage of account details.

 

In the event of a gross violation of Georgian legislation or this document by the user/viewer, the Sabcentral Studio reserves the right to cancel the account and notify the user/viewer about it.

 

4 Order

 

Only registered users can place an order/purchase products on the Sabcentral Studio's website. To place an order or buy a product, the user must follow the instructions on the website.

 

The user selects products on the website and communicates to purchase them;

 

When the user places an order electronically, the Sabcentral Studio will immediately confirm the receipt of the order electronically, specifically informing the user through the website that the order has been placed and will agree on the delivery terms.

 

After receiving the order, depending on the nature of the order, the delivery terms will be agreed upon with the customer.

 

The agreement on delivery timelines will occur with the customer if the order pertains to the creation of a work of art. An order is considered placed only upon confirmation by the website, which leads to subsequent settlement.

The Sabcentral studio reserves the right to cancel the order, when there is an objective basis for canceling the order, such as fraudulent cases, software or technical malfunctions, the customer does not settle according to the agreed terms, and others.

 

 

5 Payment Methods

 

Payment for the order in the Sabcentral Studio can be made by card payment through banking institutions operating in Georgia or by transferring funds to the organization's bank account and providing the electronic form of the document confirming the transfer of funds to the Sabcentral Studio;

 

6 Terms of Order Receipt and Delivery​

 

The customer can use courier services or pick up the product themselves from the pickup point.

 

7 Courier service

 

The responsibility for damage to the item during transportation lies with Sabcentral Studio if the transportation is carried out through a partner courier service of Sabcentral Studio;

 

The delivery in Tbilisi is carried out within 1 to 3 working days from the order preparation. In the regions, it is within 3 to 7 working days from the order preparation. The customer has the opportunity to determine the date and time interval for receiving the order before placing the order.

 

Depending on the specifics of the order, Sabcentral Studio may require more time (but not more than 60 calendar days) to deliver the order than specified in these terms and conditions, of which the customer will be informed in advance before placing the order.

8 Order Pickup

 

In the event that the customer chooses to pick up the order, details related to the pickup location will be confirmed with the customer additionally.

 

9 Return Policy

 

According to Article 13 of the Law of Georgia on "Consumer Rights Protection", the consumer has the right to refuse the contract and return the goods without providing any reason, within 14 calendar days, which will be counted from the receipt of the goods.

 

10 ​Refund Policy

​

In the event that the customer cancels the contract and returns the product, the refund by the Sabcentral Studio will be made to the customer's bank account within 14 days from the delivery of the product, excluding the costs of courier service and product manufacturing;

 

The customer is obliged to bear the costs associated with the return of the product themselves;

 

The return of the item must be made to the following address:

The customer does not have the right to refuse the contract and unconditionally return the product:

 

The product is made/fulfilled according to the individual order of the customer;

 

11  Intellectual Property Rights

 

The products posted on the website are protected by the copyright laws of Georgia and represent the intellectual property of Davit Matchavariani. The user must not engage in any actions that infringe upon the intellectual property rights held by the author. Any reproduction, announcement, distribution, or redistribution of the content of the website and the posted works, in whole or in part, by any means (including caching, creation), sale, resale, retransmission, various types of merchandising, printing of posters, or any form of use is prohibited; if it is possible to download or print any material within the service, then such material can only be downloaded on one device (printing may be possible in written form) and only for your personal, non-commercial use, based on the relevant license issued by the author;

 

12   Rules for Ddispute settlement / Regulatory Legislation

 

The relationship between the Sabcentral studio and the participant/viewer is regulated by the current legislation of Georgia.

The claim will be reviewed within 12 days from the receipt of the claim, and the customer will receive a reasoned response in the same communication form.​

 

Any disagreement arising between the parties will be resolved through negotiations. In case of failure to reach an agreement, the dispute existing between the parties will be reviewed by the court in accordance with the procedures established by the legislation in force in Georgia.
